Southwark Crown Court learned that on January 15, 2016, a pipefitter working for Fascel Group Limited was working to transfer a pump set from his pallet to an elevated platform at Goodman’s Fields.

The pump unit fell on him. As a result, the worker was trapped under the unit and sustained serious injuries, including multiple fractures and dislocations.

An HSE investigation revealed that Fascel Group Limited had been hired to perform mechanical and engineering work on the project which included the installation of the pump set.

The company had not ensured that a safe working system for the movement and positioning of the pump set was communicated to the operators carrying out the work.

Luton’s Fascel Group Limited pleaded guilty to breaking CDM regulations and was fined £ 36,000 with £ 34,235.45 in costs.

Speaking after the hearing, HSE inspector Gabriella Dimitrov said: “Those who supervise the work have a responsibility to design safe working methods and to provide the necessary information, instruction and training to their workers.

“Businesses need to know that the HSE will not hesitate to take appropriate enforcement action against those who fail to meet the required standards. “
